1. Acceptance of Terms

Welcome to LymeTrack (“App,” “Service,” “we,” “us,” or “our”), a wellness tracking application operated by Light Works Studio, LLC (“Company”), a limited liability company organized under the laws of Missouri, United States.

By downloading, installing, accessing, or using LymeTrack from anywhere in the world, you (“user,” “you,” or “your”) agree to be bound by these Terms of Use (“Terms”) and all applicable local laws and regulations. If you do not agree to these Terms, do not use the App.

3. Eligibility and Age Requirements

Global Age Requirements

To use LymeTrack, you must meet the minimum age requirement in your jurisdiction:

• United States: 13 years or older
• European Economic Area: 16 years or older (13 with parental consent where permitted)
• United Kingdom: 13 years or older
• Canada: Varies by province (generally 13-14)
• Australia: 13 years or older
• Other Jurisdictions: The age of digital consent in your country

You must have the legal capacity to enter into binding agreements and not be prohibited from using the App under applicable laws.

4. Account Registration and Security

• You must provide accurate, current, and complete information
• You must use a valid email address you control
• You may not impersonate others or provide false information
• You must comply with all applicable laws in your jurisdiction

You are responsible for maintaining account confidentiality and must immediately notify us of unauthorized access at [email protected]. Multi-factor authentication is recommended where available.

LymeTrack provides wellness tracking tools including:

• Daily wellness check-in tracking
• Lifestyle factor monitoring
• Personal pattern visualization
• Streak tracking and reminders
• Data export for personal use
• Journal entries for personal documentation
• Wellness trends and correlations (informational only)

All features are for personal wellness tracking and informational purposes only.

7. International Use and Compliance

LymeTrack is available globally but some features may not be available in all countries. You are responsible for compliance with local laws, determining whether the App is legal in your jurisdiction, and tax obligations in your jurisdiction.

8. User Conduct and Responsibilities

Acceptable Use

You agree to use the App only for lawful purposes, respect the rights of others, and comply with these Terms and all applicable laws.

Prohibited Conduct

You must NOT:

• Use the App for any illegal or unauthorized purpose
• Transmit viruses, malware, or malicious code
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to extract data
• Misrepresent the App as providing medical services

9. Intellectual Property Rights

All App content, features, and functionality are owned by Light Works Studio, LLC and protected by international copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of wellness data and content you input. You grant us a worldwide, non-exclusive, royalty-free license to use your content solely to provide the Service, improve our Service, and create anonymized analytics.

10. Privacy and Data Protection

Your use of LymeTrack is governed by our Privacy Policy, which complies with GDPR, CCPA, PIPEDA, and other applicable data protection laws.

11. Subscription and Payments

Subscription Options

• Free Tier: Basic wellness tracking features
• Premium Subscriptions: Monthly, annual, or lifetime options

Payment Terms

Subscriptions auto-renew unless cancelled. Prices include applicable taxes (VAT/GST where applicable). Cancel anytime through app store settings. 14-day cooling-off period applies for EU/UK users.

12. Disclaimers and Limitations of Liability

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not liable for personal injury or health issues
• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
• Some jurisdictions don't allow these limitations, so they may not apply to you

13. Indemnification

You agree to indemnify, defend, and hold harmless Light Works Studio, LLC from any claims arising from your use or misuse of the App, violation of these Terms, violation of any laws, or medical decisions based on App use.

14. Termination

Your Right to Terminate

Stop using the App at any time. Delete your account through app settings or by contacting support. Export your data before deletion.

Our Right to Terminate

We may suspend or terminate your account for violation of these Terms, illegal activity, extended inactivity (with notice), or legal requirements.

15. Dispute Resolution

Governing Law

These Terms are governed by the laws of Missouri, United States. Your local mandatory consumer protection laws may also apply.

1. Informal Resolution: Contact [email protected] first
2. Mediation: Optional mediation if informal resolution fails
3. Arbitration/Courts: Binding arbitration in Missouri for US users; local courts for EU/UK users

16. Regional Specific Terms

• European Economic Area & United Kingdom: 14-day withdrawal right, local consumer protection laws apply
• Australia: Consumer guarantees under Australian Consumer Law apply
• Canada: Provincial consumer protection laws apply

17. General Provisions

These Terms and our Privacy Policy constitute the entire agreement. If any provision is found invalid, the remaining provisions continue. Our failure to enforce any provision doesn't constitute a waiver. These Terms are provided in English; translations are for convenience only.
